These are the frequently asked questions I receive as an underage drinking citations attorney.
Will I Need to Go to Court?
In most cases, your ticket or citation will have a court date on it. If you retain an attorney you will not need to appear in court. It is very important that you retain an attorney prior to your court date. This ensures that your attorney can take the appropriate actions to continue your case.
Will My Insurance Go Up?
This depends on whether there is a drinking charge as well as an underage drinking charge. In almost all cases, the underaged drinking charge can be handled in a manner that will not result in an insurance increase.
What Documents Do I Need To Provide?
Bring the ticket/citation the officer gave to you to my office. Office hours are Monday-Thursday 9:00AM-4:00PM. On Fridays, please call first at 252-752-0297.
Will I Have to Do Community Service?
Yes, you most likely will have to perform community service. We have a list of organizations and their points of contact that enjoy having students volunteer with them. The court knows the organizations on my list and the time volunteering with them has been accepted and approved in the past.
Can I Participate in a First-Time Offenders Program to Avoid the Penalties?
Yes there is a program that 1st time offenders can attend to help keep this charge off their record. Please call us to receive details and literature.
How Severe is a Charge of Underage Drinking and What are the Penalties?
Underage drinking is a crime under the NC General Statutes. A conviction will become part of your permanent criminal record. The best outcome is to get the charge dismissed. It will still appear on your record as a dismissal but not as a conviction. This distinction may be very significant for your future.
How Do I Answer Future Questions On A Job Application About My Ticket?
Read the questions carefully and answer TRUTHFULLY!
For example: A 20 year old student receives an underage drinking ticket, hires me and this ticket is dismissed. The student applies for a job and the questions would include:
Question: Have you ever been charged with a crime under NC General Statutes?
Answer: Yes, I was charged with underaged drinking when I was a 20 year old college sophomore. After I participated in an alcohol education program and performed community service, the charge was dismissed.
